User Terms

Welcome to the ViewFi site ('the Site'), provided by Vieworks Limited, a company registered at Kemp House, 160 City Road, London, United Kingdom ('ViewFi', 'us', 'our'). The Site, along with any related services, technologies, software, or platforms (collectively, the “Services”), is designed to enable businesses to reward viewers for watching videos on websites and social media networks through competitions, rewards, and loyalty schemes. These Terms and Conditions ('Terms') outline how we provide these Services.

By using or accessing the Services, you acknowledge that you agree to these Terms and our Privacy Policy. IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THESE TERMS, PLEASE DO NOT ACCESS THE SITE OR USE THE SERVICES. Please read these Terms carefully as they constitute a legally binding agreement between you and ViewFi. We reserve the right to revise, modify, change, or remove portions of these Terms at any time at our sole discretion. The date of the latest update is indicated at the end of these Terms.

By opening a subscription-based paid account with ViewFi, you agree to timely pay all charges incurred by your account, including applicable taxes, according to the billing terms in effect at the time the charge becomes payable. If payment cannot be charged to your credit card or the charge is returned for any reason, ViewFi may suspend or terminate your account. ViewFi reserves the right to change the amount of or basis for determining any fees or charges for services we provide and to institute new fees, charges, or terms effective upon prior notice to customers (which may be sent by email to the address you have provided). You are responsible for managing your plan. Failure to do this before the anniversary date will result in the renewal of the plan for the current period. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS. All provisions of these Terms that should survive termination shall survive termination, including, without limitation, warranty disclaimers, indemnity, and limitations of liability.

PLEASE NOTE THAT SOME SERVICES ARE CURRENTLY PROVIDED IN THEIR BETA VERSION, WHICH MEANS FEATURES HAVE NOT BEEN FULLY IMPLEMENTED OR REFINED. AS WITH ANY BETA VERSION, THE SERVICES CONSTITUTE A WORK IN PROGRESS AND MAY HAVE UNRESOLVED ISSUES. WE APPRECIATE YOUR PATIENCE DURING THIS FINALIZATION STAGE AND ENCOURAGE YOU NOT TO USE THIS BETA VERSION OF THE SERVICES UNLESS YOU ARE COMFORTABLE USING BETA SOFTWARE AND UNDERSTAND THE IMPLICATIONS.

The underlying platforms of the Services are the proprietary property of ViewFi or our licensors or licensees. By subscribing to our Services, ViewFi grants you a personal, revocable, non-assignable, and non-exclusive license to use the Services for the term of the subscription in accordance with these Terms, unless terminated earlier. 'ViewFi' and other trademarks, slogans, service marks, and trade names that appear via the Service are proprietary to ViewFi. You shall not remove or alter any copyright notice, trademark, or other proprietary notice affixed to any material provided by ViewFi.

ViewFi facilitates companies running competitions and rewards that you can enter as a user. The 'Competition Owner' is fully responsible for ensuring their competition complies with all applicable rules and regulations in the relevant countries. ViewFi is not responsible or liable for any Competition Owner's failure to comply with these rules. Competition Owners must ensure their competition fully complies with the rules and regulations of any social network or third party on which it is run. ViewFi will not be held responsible for the loss of any data or accounts due to third-party actions related to activities against their guidelines. You acknowledge and agree that ViewFi is not responsible or liable for the Competition Owner's use or distribution of information you provide. Please see each Competition Owner's promotion rules, terms, and privacy policy for details on how they use your personal information. As ViewFi can be used on any website in any country, by using ViewFi, you acknowledge that you are responsible for compliance with any local laws.

VIEWFI DOES NOT SPONSOR, ADMINISTER, OR ENDORSE THE CONTENT OF ANY PROMOTION OR GIVEAWAY DISTRIBUTED THROUGH THE SITE UNLESS OTHERWISE STATED AND IS THEREFORE NOT LIABLE.

ViewFi may require you to provide personally identifiable information to participate in certain promotions. By choosing to provide this information, you acknowledge and agree that ViewFi may use any information you provide in accordance with these Terms and ViewFi's Privacy Policy.

Technical support is provided by ViewFi via email during regular business hours (Monday to Friday, 9 AM CET to 6 PM CET) by sending your technical inquiries to info@viewfi.io. ViewFi will respond to your support request within a reasonable time period.

To access the Services, you must first subscribe by providing the requested information and setting up a username and password. Based on the package you choose, you may grant account access to additional users in your organization and specify the type of access each user shall have as part of the Services. Upon signing into their account and using the Service, all such users shall also be subject to these Terms and will be responsible for the activity that occurs through their account and information shared.

Keep your account password secure and always log off from the Services when leaving your computer unattended. Notify us immediately of unauthorized use of your account or any related security breach by writing to info@viewfi.io.

The primary purpose of the Services is to aggregate third-party websites, applications, interfaces, and other materials (“Third Party Applications”). ViewFi does not own or control any of these. ViewFi serves only as a collector of such Third Party Applications for your convenience and does not endorse or recommend any Third Party Applications. ViewFi is not liable for any changes or inoperability of such Third Party Applications, whether temporary or permanent.

ViewFi assumes no responsibility for the content, guidelines, privacy policies, or practices of any third party. By using the Services, you expressly relieve ViewFi from any liability arising from your use of any Third Party Applications. You acknowledge that Third Party Applications may be protected by copyrights, patents, trademarks, trade secrets, and other proprietary rights. You agree not to modify, publish, transmit, distribute, perform, transfer or sell, create derivative works of, or exploit any Third Party Applications, and to abide by their terms of use.

ViewFi reserves the right to suspend or terminate your account at any time, at our sole discretion. ViewFi also reserves the right to remove any user content that is abusive, illegal, disruptive, or otherwise fails to conform to our standards, and to limit or revoke your access to the Services in full or part for any reason, including technical difficulties or violation of these Terms.

YOU ACKNOWLEDGE THAT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, THE SITE, AND OTHER MATERIALS PROVIDED ARE PROVIDED ON AN “AS IS” BASIS. USE OF THE SERVICES AND RELIANCE ON THE SITE CONTENT IS AT YOUR OWN RISK. VIEWFI DISCLAIMS ANY AND ALL WARRANTIES RELATING TO THE SERVICE, THE SITE, THEIR CONTENT, AND OTHER MATERIALS, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

ViewFi is committed to safeguarding any personal information collected through our Services and ensuring that you are fully informed about how your personal information will be used and stored. You agree to use data collected from the Services responsibly and comply with all local data laws, including GDPR.

(a) These Terms constitute the entire agreement between the parties regarding the subject matter hereof, replacing any prior agreements.

(b) You affirm that you are fully able and competent to enter into these Terms and comply with them.

(c) Failure to enforce any provision will not constitute a waiver. If any provision is found unenforceable, it and related provisions will be interpreted to best accomplish the provision’s essential purpose.

(d) This Agreement will be governed by the laws of the United Kingdom, and the parties submit to the exclusive jurisdiction of the courts of the United Kingdom.

You shall indemnify and hold harmless ViewFi and its directors, officers, employees, representatives, and agents (“Related Parties”) against all demands, claims, actions, liabilities, losses, costs, damages, or expenses (including reasonable attorneys’ fees) (“Damages”) arising from any violation of these Terms by you or related to your use of the Services.

THE CUMULATIVE LIABILITY OF VIEWFI FOR ALL CLAIMS RELATING TO THE SITE OR SERVICES SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU FOR THE SERVICES. VIEWFI WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, OR SIMILAR DAMAGES, RESULTING FROM THE USE OR INABILITY TO USE THE SITE OR SERVICES.
